Terms of Service

1. About these terms

These terms govern your use of the Partify website, apps and services. By browsing the site, creating an account or placing an order you accept them. If you do not accept them, please do not use the service.

We may update these terms as the service changes. The version published here is the one that applies, and material changes are notified to account holders by email before they take effect.

2. Your account

You need an account to place an order. You are responsible for keeping your login details secure and for everything done through your account. Tell us straight away if you believe someone else has access to it.

You must be at least 18 years old and provide accurate details. We may suspend or close an account that is used fraudulently or in breach of these terms.

3. Marketplace and sellers

Partify lists parts sold by us and by verified third-party sellers. Where a part is sold by a third party, your contract for that part is with that seller, and Partify acts as the platform that facilitates the sale, payment and support.

Sellers are responsible for the accuracy of their listings and the condition of the parts they send. We verify sellers before they can list, and we step in where a seller does not meet our standards.

4. Orders and pricing

An order is an offer to buy. A contract forms when we confirm the order by email. Prices are in New Zealand dollars and include GST unless stated otherwise.

We take care with pricing and stock, but errors happen. Where a part is listed at an obviously incorrect price or is no longer available, we may cancel the order and refund you in full before dispatch.

5. Fitment information

Fitment data is provided as a guide. Vehicles are often modified or supplied in regional variants, so we recommend confirming the part number against the part you are replacing before you fit it. Buying the wrong part because fitment was not checked is treated as a change-of-mind return.

6. Delivery, returns and warranty

Delivery timeframes, the returns process and warranty cover are set out on our Shipping Info, Returns and Warranty pages. Those pages form part of these terms.

7. Acceptable use

When using Partify you agree not to:

• Use the service for anything unlawful or fraudulent
• Scrape, copy or resell our catalogue or fitment data
• Interfere with the security or operation of the site
• Impersonate another person or business

8. Intellectual property

The Partify name, logo, site design, catalogue structure and fitment data belong to us or our licensors. You may use the site to research and buy parts, but not to build a competing product or dataset.

9. Liability

Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. Subject to those rights, our liability for any claim connected with an order is limited to the amount you paid for the part in question, and we are not liable for indirect losses such as lost income, towing, hire vehicles or labour.

Where you buy for business purposes, the Consumer Guarantees Act is contracted out of to the extent permitted by law.

10. Governing law

These terms are governed by New Zealand law, and the New Zealand courts have exclusive jurisdiction over any dispute arising from them.
